A Mental Nervous Limitation on an individual disability policy means that if you have a claim related to a mental illness or a psychological illness, the benefits will not be paid. This is not to be confused with neurological conditions such as dementia or Alzheimer’s. Those would be covered the same as any other claim.

Mental Nervous Limitations come in several differerent forms.

Mental Nervous Exclusion

If you have a pre-existing condition related to a psychological disorder such as anxiety or depression, if you are currently being treated or have been treated in the last 3 years, chances are the company will put an exclusion on your policy for mental nervous. This means that any claim related to a psychological disorder will not be covered. This includes conditions such as ADHD, addiction, anxiety and depression.

If you apply for an individual disability insurance policy and it comes back with an exclusion, it is important to ask if or when this can be reconsidered. Sometimes the company will say the limitation is permanent and therefore they will never reconsider. Other times they say they will reconsider after a certain amoun tof time has elapsed. After that time, you may apply to remove the exclusion. That entails an adjustment application, new medical questions and records from your treating physician.

2 Year Mental Limitation

Some policies require a 2 year mental limitiation on an individual policy regardless if you have any pre-existing conditions. A 2 Year Mental Limitation means that if you have a claim related to a psychological disorder, it would only pay that benefit for up to 2 years.

This is required for all policies issued in California and for some medical specialties including emergency medicine physicians, anesthesiologists, CRNAs and in some circumstances dentists.

Most policies offer you the decision whether or not you want to have a 2 year mental limitation on your policy. A 10% discount is included if you add this limitation. If you wish to have full mental benefits for the full policy period, you will pay an additional 10%.
